COVID has accelerated digital transformation. McKinsey reports that US productivity in Q2 and Q3 2020 experienced the largest increase in productivity in over 60 years in part because of it—and this includes the legal market.

In a law firm, a successful digital transformation will include these three areas:

1. A formally adopted Information Governance policy/retention schedule with a change management plan to ensure defensible disposition.
2. An upfront digital workflow to reduce the amount of paper being produced.
3. Off-site records storage contracts that enable you to destroy efficiently and cost-effectively.

Over the next few weeks, we will take a deep dive into each of these areas.  Here, we will address off-site records which can be one of the most surprising challenges.  Here are some key questions to consider:

1. Are you able to destroy off-site records without reviewing the contents? 
2. Does your current contract(s) contain allowances for destruction?
3. Do you have a clear understanding of how much storage can be destroyed before triggering contract minimums?
4. Is your retrieval and services pricing competitive in today’s market?
5. Do you have an automated mechanism in place to trigger retention events and to update your RMS to reflect records destruction?
